Most companies with a strong export compliance program have manuals, training and policies and procedures in place to handle their day-to-day business. But surprisingly few exporters have ever planned what to do if and when Federal export enforcement agents arrive at their doorsteps. That first encounter with the government in an investigation or enforcement action is critical. Is your company prepared?

This webinar is part of ECTI’s special three-part series on preparing for, and handling, export enforcement actions. In this first installment, we will describe how your company can be proactive and put the policies, procedures and resources in place to effectively handle any government enforcement matter. From the company Receptionist to the Chief Executive Officer, each person in the chain needs to know what to do – in advance – when a subpoena is served or federal agents arrive in your lobby. We will identify the concrete steps that you can take today which will allow you to turn what most organizations would think is a cataclysm into a manageable event.
Specifically, this webinar will:
- Provide an overview of the current (and anticipated) government export enforcement environment, including those areas that are at the forefront of BIS, DDTC, and OFAC enforcement initiatives;
- Assess the risks involved in not preparing for enforcement actions, and the rewards that your company can reap by having a proper enforcement response plan in place;
- Describe the company policies and procedures that need to be in place in the event that your company comes under investigation or is subject to enforcement; and
- Identify the tools and resources that your company will need to respond to any government export enforcement action.
This webinar will be especially valuable for companies that:
- Operate in heavily regulated and sensitive industries such as defense, energy and cutting-edge technology;
- Manufacture, sell, or distribute merchandise that is subject to licensing or special scrutiny from BIS, DDTC or other government agencies;
- Have a product presence (or are expanding their footprint) in emerging markets such as Latin America, the Middle East, and Southeast Asia and in those counties known for transshipment issues or doing business with embargo and sanction countries;
- Are third-party logistics providers, freight forwarders and shipping agents which could find themselves under investigation for violations committed by their clients; and
- Any company that either has no export compliance plan or no tab in its compliance manual for “Responding to Government Enforcement Measures” and wants to avoid the higher penalties that can come with such omissions.
This webinar will provide PowerPoint slides and include live video and commentary from Stephen Wagner who specializes in international trade law and government regulatory and enforcement matters. Webinar participants are invited to submit questions during the webinar, the final 30 minutes of the webinar will be allotted to answering attendees' questions.
