The potential opportunities and financial rewards associated with expansion into new foreign markets can seem limitless. As corruption in international business is commonplace and even rampant in many parts of the world, the Foreign Corrupt Practices Act (“FCPA”) was enacted to prohibit U.S. persons and companies from making corrupt payments to foreign officials in an effort to influence their actions or secure an improper business advantage.
The FCPA also contains provisions that prohibit publicly traded companies from maintaining false or inaccurate records and failing to implement formal accounting controls.
