Export Control Reform for Aerospace Exporters



For years, the US aerospace industry pushed for relief from a burdensome and antiquated export control system. Now, that effort has finally paid off with substantial reforms to both the International Traffic in Arms Regulations (ITAR) and the Export Administration Regulations (EAR), which will directly impact manufacturers and exporters of aircraft and aircraft components.

The time for talk is over, and the moment for action is now! Learn what you need to know to prepare your organization to take advantage of the new rules. Time is short -- these changes will come into effect before you know it. Join us as we tackle these topics and more:

  • The major changes to controls on aircraft and aircraft components in US Munitions List Category VIII, which will result in many (but not all!) items moving off the USML.
  • What is controlled (and what is not) by USML Category XIX for gas turbine engines.
  • What the new definition of "specially designed" really means for classification purposes, and how it is different from "specifically designed."
  • How to classify formerly ITAR-controlled items on the Commerce Control List, especially the new "600 series" Export Control Classification Numbers (ECCNs).
  • When you do and do not need a license under the EAR to export aircraft and aircraft parts, including a discussion of License Exception STA.
  • A preview of the proposed changes for spacecraft and related components (USML Category XV).
  • The actions exporters should take now to prepare for the October 15, 2013 effective date of these changes.

Speaker and Presenter Information

Scott Gearity is a Principal of BSG Consulting, bringing over a decade of consulting, training and corporate export compliance program management experience to bear for his clients. Mr. Gearity has substantial experience in military, dual-use and commercial export controls. His clients have ranged in size from small start-ups to some of the world�s largest companies, with a particular focus on the information technology, telecommunications, networking and software industries. Mr. Gearity joined BSG from Microsoft Corporation, where he was based in Ireland and managed the company's export compliance program for Europe, the Middle East and Africa. He continues to advise many non-US companies affected by US export controls. Mr. Gearity holds a Bachelor of Arts degree in international studies and economics from American University. He is a licensed US customs broker.
